This page contains the terms & conditions. Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions. By placing an order at The Case Factory, you warrant that you are at least 18 years old (or have parents' permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed at The Case Factory for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.
Events outside The Case Factory's control, which is not reasonably foreseeable, shall be considered force majeure, meaning that The Case Factory is released from The Case Factory's obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.
LIMITED PRODUCT WARRANTY AND RETURN POLICY
We at The Case Factory (TCF) warrant our products against defects in material or workmanship for a period of six (6) months from the original date of purchase of the product by a consumer (the “Warranty Period”). TCF does not warrant, and is not responsible for, any smart phone or other device made by anyone other than products manufactured by TCF. TCF does it utmost to ensure that products we sell are free from any defects at the date of purchase. If a material or workmanship defect arises with regard to any TCF product, and a valid claim is received within the Warranty Period, we will at our option: a) repair the TCF product using new or refurbished parts; b) replace the TCF product with a new or refurbished TCF product; or c) refund the purchase price of the defective TCF product. For the purposes of this limited warranty, “refurbished” means a product or part that has been returned to its original specifications. In the event of a defect, these are your exclusive remedies. Except for the limited warranty expressly set forth above or to the extent restricted or prohibited by applicable law, TCF expressly disclaims any and all other warranties express or implied, including any warranty of quality, merchantability or fitness for a particular purpose and you specifically agree that TCF shall not be liable for any special, incidental, indirect, punitive or consequential damages for breach of any warranty of any type on any TCF product. For the avoidance of doubt, the limited warranty does not cover: • Defects and damage due to loss, theft, fire, water, or natural disasters. • Problems or damage caused by misuse, neglect (knocks, dents, crushing, falling etc), accidents or unjustifiable repair or modification. • Aesthetic changes, defects and damage due to normal wear and tear and ageing (e.g. scratches, worn leather and flaking paint, etc.). It is important that customers carefully examine the item when they have been received. If your item has been damaged during transport, you must report this as soon as possible to the customer service. If you discover that an item is damaged or does not match the item you ordered, you have to contact customer service within 30 days. In addition to and without limiting the generality of the foregoing disclaimers, the limited warranty does not, under any circumstances, cover the replacement or cost of any electronic device (including but not limited to any mobile phone devices) or personal property inside or outside of the TCF product. Please note that leather is a natural material that is sensitive to humidity, grease, hand lotions, abrasive surfaces etc and the extreme wear and tear derived from the frequent use of a mobile phone (100 times per day) will cause corners, edges and colors and the general appearance of the case to deteriorate much faster than compared to other small leather goods products.
RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
As a consumer you always have 14 days right of withdrawal. If you are not completely satisfied with your purchase, or the product is found to be defective, you may return the item to us in its original condition within 14 days of receipt. An exception for this is when ordering personalised products such as embossed products or with Swarovski stickers. When returning or exchanging a product the shipping costs will be paid by the customer. Only items purchased directly from TCF’s online store will be accepted. For products purchased from authorized retailers, please get in touch with them directly for returns. Returned items must be in new condition, original packaging, including any accessories, manuals, and documentation. Non-returnable items include items purchased through retailers, incorrect products purchased, and damaged products through customer mishandling. Returns made without receipt may be refused. TCF reserves the right to deny any return.
You have the right to withdraw from a contract with us within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the items you purchased.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal written statement. Please contact us here. You may also use the attached model withdrawal form, but it is not obligatory.
NOT SATISFIED WITH YOUR PRODUCT? DID YOU RECEIVE A FAULTY UNIT, OR THE WRONG PRODUCT? SIMPLY NOT SATISFIED WITH YOUR ORDER?
Please contact our Customer Support team on email@example.com to start the return process. Please include the following information: • Order number • Proof of purchase • Video or photo of the faulty product (if applicable) • Complete delivery address • Contact telephone number In some cases, you may be required to include a video or photo of the defective product for proof in order to refund or replace the product.
Processed refunds are completed within 10 business days. Refunds will be issued based on your original form of payment (PayPal, credit card, debit card, etc.) For returned items, a full refund will be credited for defective products. For non-defective items, refund excludes all shipping and handling fees.
Items already shipped are not reversible, and must then be returned for a refund (please see the “Refunds” section above). Please note that the cost of this return has to be paid by the customer..
WANT TO SWITCH TO ANOTHER PRODUCT?
Return the product you have received and send us an e-mail telling us which product you want instead. The cost of this return has to be paid by the customer.

If you are dissatisfied with our handling of your case, please contact your national consumer protection authority.
You may also use the Online Dispute Resolution platform available on the EU Commission’s website.
We are in no way obliged to enter into alternative dispute resolution methods but will assess possible courses of action on a case-by-case basis.
For packages that are not cashed at your post office within 14 days, The Case Factory reserves the right to charge you a handling fee to cover return shipping and freight companies' administrative costs.

Most of our processing of your personal data is necessary for us to perform our contractual obligations to you, and other kinds of processing relies on TCF ’s legitimate interest for processing as set out below. The Integrity Policy applies when TCF provides services and products related to purchase, service matters and other contacts with TCF. HOW DO I UNSUBSCRIBE FROM TCF’S NEWSLETTERS AND EMAILS?
If you do no longer wish to receive our newsletters or other emails, you can unsubscribe as indicated in the particular communication, i.e. by using the unsubscribe link which is included on all newsletters and other emails. You may also contact us at email@example.com.
HOW LONG DO WE KEEP YOUR DATA?
We will retain your personal information for as long as necessary in relation to the purposes for which they were collected or otherwise processed. Unless you actively chose to sign up for our newsletter at a time of purchase online or in-store, we will not use your email-address for any other purpose than to reach you in relation to your recent purchase. If you have signed up for our newsletter we will save your data for as long as needed to provide you with this service. We will also retain your personal information as necessary to comply with applicable legal obligations, to resolve disputes, and to enforce our agreements. Statutory obligations to retain data further remain unaffected.
All personal information you provide us with or that we obtain will be handled by The Case Factory as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalog to you. The information you provide is only available to The Case Factory and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request The Case Factory to delete or correct the information held about you. By accepting the The Case Factory Conditions, you agree to the above.
